This article analyzes the new regime of autonomy and the new mode of regulation of private education following Decree-Law n. º 152/2013, of November 4 (new statute of private education). The new statute was adopted in a substantially different educational context then that existing at the time of the repealed statute. Nowadays, school autonomy is mainframe concept and modes of regulation in education are in profound transformation. Command and control mechanisms, typical of centralized school systems like ours, are replaced by more qualitative mechanisms; compliance with the norm looses place before considerations of quality and efficiency. Private schools are now able to decide, based on their educational project, how they organize and act pedagogically, and define a significant part of the curriculum they offer. In contrast, they acquire new obligations of transparency and information and national tests become a central tool for regulating the system.
