The rights to maternity and to paternity are recognized by portuguese fundamental law. However, when the holders of such rights assume the position of workers in a contract of employment, the exercise of those rights is not free from collision with the right to «freedom of enterprise», also recognized by portuguese Constitution. Indeed, taking into account that the protection of maternity and paternity includes, among others, the right to take some time off in what regards to the activity that has been contractually bounded, the interests of the employer are affected. In this way the Constitution itself "authorizes" the breach of contract of employment. Nonetheless, the harmonization exercise of the fundamental rights at issue requires that the right to «freedom of enterprise» is taken into account by the legislator when he regulates the labor protection of motherhood and fatherhood.
