The objective of the present study is to position itself on the constitutionality or not of the maximum age forecast for women to undergo assisted reproduction procedures, as set out in item I.3, § 1, of the annex of Resolution 2,168/2017, Federal Council of Medicine (CFM), considering that this age limitation may mean a real affront to the fundamental right to free family planning, as enshrined in art. 226, § 7, of the Federal Constitution of 1988. Therefore, the approach method adopted will be essentially the hypothetical deductive method, through the development of theoretical research − doctrinal − and documentary knowledge − legislative and jurisprudential analysis.
