Abstract
SANTOS, Lucineia Rosa dos and LEITE, Rita de Cássia Curvo. FAMILY COEXISTENCE AS CHILD'S FUNDAMENTAL RIGHT IN BRAZILIAN LEGAL SYSTEM. Revista Internacional CONSINTER de Direito [online]. 2020, n.10, pp.81-98. Epub June 30, 2020. ISSN 2183-6396. https://doi.org/10.19135/revista.consinter.00010.03.
The purpose of this small essay is to bring Human Rights into line with the rules of Family Law in force in Brazil in order to recognize that family life corresponds to a universal right, already embraced by the Brazilian State, and must be fulfilled by society, by community, and, especially, in the family. In this context, it is also important to affirm that family life is a fundamental right that also extends to new family models, which can be confirmed by the use of inductive empirical method in the light of scientific law and jurisprudence, and, especially from the professional performance in the respective areas. That is why it is necessary to be sensitive to apply to the concrete situations, even the most recente ones, open content standards such as those that guide Human Rights. In this context - and with a futuristic look - all family models must guarantee the free exercise of a dignified coexistence, especially in paternal-maternal-filial relations, without forgetting the undeniable responsability of the adult in the face of child hypervulnerability.
Keywords : The new family arrangements; Family living; Fundamental right of the child; Public policies focused on paternal-maternal-filial relations.
