Changes concerning familial order, the new forms of kinship and, particularly, same sex parenthood, raise ideological and cultural debates about the status of the norms regulating sexuality and kinship. Are those norms meta-historical principles not affected by social and political change according to the positive tradition of Law? Sexuality issues impose themselves on the political arena showing that the questions they raise are in the core of our society. The French debate about same sex parenthood shows the ideological and political tension between naturalization and denaturalization of sexuality and kinship of in a complex articulation implying the notion of nationality. Does the so called «symbolical order» refer also to a racial order?
