^lpt^aAssinada em 23 de setembro de 1822, a Constituição da Nação Portuguesa determinava que a “conservação, fundação e aumento” das instituições assistenciais ficaria sob responsabilidade das Cortes e do Governo, com exceção das tuteladas pelas câmaras, entidades a quem competiria promover a saúde pública. A formulação do texto da Constituição assinalava o fracasso da Comissão de Saúde Pública, que não conseguia ver aprovadas as suas ideias reformistas, mormente a do controlo municipal da assistência e da saúde. Para trás ficava mais de ano e meio de debates e um considerável número de petições, discutidas nas Cortes ou apenas analisadas pela Comissão. É sobre este universo que se debruça o presente texto, que se propõe questionar as ideias apresentadas como revolucionárias pelos liberais no âmbito da saúde pública à luz das experiências vividas nas décadas anteriores.^len^aSigned on 23rd September 1822, the Constitution of the Portuguese Nation stated that the Cortes (Constituent Assembly) and the government would be responsible for the “preservation, establishment and increase” of welfare institutions, with the exception of those controlled by the local councils, which would be responsible for the area of public health. The wording of the Constitution indicated the failure of the Public Health Commission, which had been unable to obtain approval for its reformist ideas, in particular municipal control of welfare and health. This was the outcome of more than a year and a half of debates and numerous petitions discussed in Parliament or simply analyzed by the commission. The aim of this study is to examine this field and question the ideas presented by the liberals as revolutionary in the public health sphere in light of the experiences of previous decades.
