Resulting from investigations related to the research projects entitled “Majorities which are minorities, invisible which are (un)speakable: an ethnographic analysis on subjects outside of dominant discourses” and “Mapping of lawsuits regarding the access of Indians of Grande Dourados/MS to justice”, the article roughly analyses the arguments that support the rejection of anthropological assessments within criminal cases by law operators of the Mato Grosso do Sul justice court (TJMS). We emphasize the prevalence of the Indian Statute principles, no longer valid according to the Federal Constitution of 1988, as well as the confusion in certain judgments of Mato Grosso do Sul justice court between anthropological and psychological/psychiatric assessments.
