^lpt^aEste artigo revisita o princípio da função social da propriedade, a propósito da questão da reforma da legislação florestal. O problema da terra abandonada, que potencia a propagação de fogos, e da eventual imposição de deveres, fiscais e outros, aos proprietários, não ficou resolvido mas reavivou o debate sobre os limites do direito de propriedade (rústica) no confronto com interesses sociais como a segurança, a protecção do ambiente e a defesa de direitos de terceiros. A propósito do relatório da Comissão Técnica Independente, cujo ponto 10 acentua a necessidade de um maior controlo do cumprimento dos deveres de limpeza e cuidado pelos proprietários rurais, empreendeu-se um percurso pelo Direito Constitucional e pela jurisprudência constitucional portuguesa, bem assim como pela Constituição brasileira - a que mais desenvolvimento deu ao princípio no seu seio -, a fim de analisar a valia de algumas soluções eventualmente a implementar no futuro.^len^aThis article revisits the principle of property's social function having in mind the recent reform of forestries legislation. The problem of abandoned land, which encourages the propagation of fires, and the eventual imposition of duties and taxes on landowners, has not been solved but has revived the debate about the limits of (rustic) property rights in confronting social interests as security, environmental protection and the defense of third party rights. Regarding the report of the Independent Technical Commission (point 10) emphasising the need for a greater control of the fulfilment of the duties of cleaning and care by the rural proprietors, we go through Portuguese Constitutional Law and constitutional jurisprudence, as well as through the Brazilian Constitution - the one that more developed the principle - in order to analyse the value of some solutions that may be implemented in the future.
