The duties of manufacturers and distributors that generate criminal liability for defective products are those to oversee, warning and withdrawal. The article analyzes these duties and then determines if the criminal Chilean legislation can cover this type of responsibility, or if on the contrary, the system is dualistic and the common illicit must be used for better consumer protection.
