O presente texto, utilizando-se do método dedutivo, a partir de premissas constatadas na história do sindicalismo brasileiro, tem por objetivo contemplar e refletir sobre a evolução das relações de trabalho e seus efeitos no direito coletivo, em especial, no modelo de organização sindical brasileiro, mantido desde 1943, considerando os princípios democráticos constitucionais. A passagem histórica se justifica pela prática que se adotou e que grande influência trouxe na forma de atuação dos sindicatos. Também a Reforma Trabalhista e a pandemia carregaram o sindicalismo com uma responsabilidade na efetiva representação de trabalhadores. Ao final, fica a resposta difícil para o questionamento do modelo mais adequado aos fundamentos constitu- cionais brasileiros no aspecto trabalhista.

The present paper aims to reflect on the evolution of work relations and its effects on Collective Labor Law, especially on the Brazilian model for labor unions, considering the democratic principles stipulated in the current Constitution. This historical period was chosen due to the practices that were adopted and their deep influence on how unions act. The paper will also analyze how the Labor Reform of 2017 and the Covid-19 pandemic brought the responsibility for the effective representation of the working class back to unions. Finally, it presents an answer for the very pressing question as to the most adequate union model, considering the constitutional principles regarding labor relations in Brazil.
