BAIAO, Vitorino; RODRIGUES, Alexandre; FERRE, Carme e PAQUETE, Patrícia. Continental and regional perspective of portuguese legislation on the informal caregiver: documental analysis. Mill [online]. 2022, n.esp11, pp.22-32. Epub 31-Dez-2022. ISSN 0873-3015. https://doi.org/10.29352/mill0211e.26324.
Since the dawn of humanity, the art of caring and the role of caregiver have been extremely important for human life.
On 6 September, with Law nº 100/2019, the Statute of the Informal Caregiver was published which, despite being a national legislation, the political-administrative regime allows legislative diversity between the mainland, the Autonomous Region of the Azores and Madeira. In view of this, the objective was to analyze the legislation on informal caregivers in the three regions and what their implications are.
A document analysis was carried out on the legislation on Informal Caregivers, published at national level until February 2021. In order to organize the extraction of results in a systematic way, an analysis grid was built with the following criteria: Type of Legislation; Publication date; Defined concepts; Requirements to be an Informal Caregiver / Person Cared for; Informal Caregiver Rights/Duties; Organization and Support Structures. The descriptors used were: Status, Caregiver and Informal Caregiver. The results showed common aspects in the three regions (right to training / information, psychological support, financial support), common aspects only in two of the three regions (legal support and/or support in the elimination of architectural barriers) and aspects that are only found in one of the regions (off system, caregiver allowance). It is concluded that, in light of the legislation, being an informal caregiver is different in the three different regions under study.
