Abstract

With the advances recorded in recent decades in the field of bio-technology, traditional knowledge, in its various manifestations, has become an important bio-information input for innovation. In this context, the relationship between traditional knowledge and intellectual property has also developed into a burning issue. The Sixth Conference of the Parties to the Convention on Biological Diversity, which took place at the Hague in April 2002, considered the possibility of establishing a standard framework for this question. The present article considers the interest and the possible form of such a standard framework. Given the impossibility of applying the existing mechanisms, it is important to agree on appropriate international regulations guaranteeing that this knowledge is both disseminated and protected, thus preventing misappropriation by the big biotechnology companies and facilitating access to such knowledge on fair terms.
