The central thesis of this article is that in prisons the inmate population suffers, in general, and the groups excessively represented in them, in particular, human rights regressivity. From an ethnic perspective, the study method is documentary and focuses exclusively on Afro-descendant people as subjects of special protection, problematizing on three basic points, namely: the representative ideology of Afro-descendant people as criminals; the regressivity of human rights in the Americas as a fact that drives crime levels; and this situation doubly aggravated due to overcrowding in prisons as the norm.
