Abstract

MORENO, Juana María González. The Conciliation of work and family life in the Community Law: A feminist legal analysis . Ex aequo [online]. 2011, n.23, pp.39-52. ISSN 0874-5560.

From the feminist theory and, in particular, from the feminist legal theory, our work analyze the situation of the conciliation of work and family life in the Community Law (today, the European Union Law) and it show how this hasn´t included the women's need of an equitable distribution with the men of the family and domestic tasks. In the Community Law the conciliation of work and family life isn´t perceived as a citizenship question. The citizenship is formulated around the public sphere and this sphere has as referent the men way of life of which the family and domestic tasks aren´t accepted. Contrary these tasks to belong to function of social reproduction of human life that the women must to take on. What become apparent the masculine bias and of gender of Community Law.
