Abstract

In recent years there has been intense theoretical and empirical debate around feminism and law, emerging feminist critical theory of the law as an important forum for debate and reflection that challenges the more traditional perspective of law. The preliminary question, and wider, is whether the law can be an instrument for promoting equality and an effective instrument for women to guarantee their rights, or if, on the contrary, it is a system of oppression. In this article, I raise some hypothesis to the research of this question, using as case-study one of the feminist demands that deserved more attention by the state and law in recent decades: the legal fight against domestic violence against women.
