For centuries, the medical ethic was based on the Hippocratic oath, according to which the need for the patient’s approval for treatment was inexistent1. In the end of the first half of the twentieth century2,3, the concept of Informed Consent began to take shape. Along with the definition of Bioethical principles4,5, the dominant paternalist clinical practice was progressively abandoned. Informed Consent is the starting point for a clinical practice based on the respect for the freedom, autonomy and self-determination of the individual. It is an inevitable consequence of the bioethical determinations that underlie the leges artis. It has a broad protection granted by international standards6 and the Portuguese legal system, at the level of constitutional, criminal and civil law, as well as in the Health Care legislation7.
