Abstract

Dignity grounds a dualistic conception of constitutional rights, freedom rights, tributary to personal dignity and social rights, subsidiary to social dignity (Neto, 2014), which the State is responsible to ensure. The increase of life expectancy, combined with a persistent risk of poverty and material deprivation in the population aged 65 and over, calls for an analysis of old age social policies designed to guarantee the right to a life with dignity. This article presents the results of a study that seeks to identify changes and/or reconfiguration processes of measures and policies with an impact on guaranteeing the rights of old people to a dignified life. Based on a document analysis of legislative measures, published between 01/01/2006 - 31/12/2015, we based our search for specific references to the term dignity. Four periods are identified reflecting political options, internal and external constraints and we concluded that there is an almost absence of the term dignity and its definition or interpretation.
