Abstract

OLIVEIRA, Miguel Arnaud de. The Three-Dimensionality of Sports Justice. e-Pública [online]. 2021, vol.8, n.1, pp.244-266.  Epub Jan 22, 2022. ISSN 2183-184X.  https://doi.org/10.47345/v8n1art9.

With this article we propose to make a brief incursion in the ecosystem of the jurisprudential dialogue around the "sports issues", which was fostered after the establishment of the Court of Arbitration for Sport. Without exhaustion, we analyze the different approaches used by the various courts called to rule on identical cases.

We privilege the divergence of approaches, which are very marked, between the Supreme Administrative Court and the Central Administrative Southern Court, while making a brief reference to the role of the Constitutional Court, the European Court of Human Rights and the Court of Arbitration for Sport.

A wide range of decisions on two major issues is addressed, the confrontation between freedom of expression and the right to honour and the nature of the responsibility of clubs for the acts performed by their supporters. In addition, there is a brief reference in two judgments, on different but equally noteworthy subjects.
