Abstract

MACHADO, Caetano  and  LOCATELLI, Carlos. Brazilian journalists in the dock: frameworks of judicial sentences in actions of moral damages. Media & Jornalismo [online]. 2018, vol.18, n.32, pp.119-137. ISSN 1645-5681.

This article presents preliminary results of an ongoing investigation into sentences of moral damages lawsuits against journalists and newspaper companies in Santa Catarina between 2009 and 2017. A total of 102 sentences were analyzed based on the news published by the Press Office of the Court of Justice of Santa Catarina. Of these, 55.9% were favorable to defendants (vehicles and journalists), especially grounded in freedom of expression and information. In contrast, those in which the defendants were convicted (44.1%), triggered recurrently rights to privacy, honor and image.
