This article criticizes the Kelsenian normative framework in the light of the Neurobiology of Humberto Maturana and Francisco Varela. In this sense, we will study how the concepts developed by Chilean scientists as closed system, structural coupling and “parenthesis objectivity” provide grounds to diverge from Hans Kelsen’s hermeneutic vision based on normative framework theory.

The methodology used works with zeptic and dogmatic reflection, based on the technique of argumentation, formal logic and philosophical discussion, used in the relationship between the following areas of scientific knowledge, Biology and Law.

Finally, as a conclusion, we obtained a reappraisal of the Kelsenian interpretive mode based on the Neurobiology studied.
