Abstract

REICHELT, Luis Alberto  and  PEGORARO JUNIOR, Paulo Roberto. E-PROCEDURE, HYPERTEXT AND RIGHT TO A FAIR TRIAL. Revista Internacional CONSINTER de Direito [online]. 2019, n.8, pp.165-178.  Epub June 28, 2019. ISSN 2183-6396.  https://doi.org/10.19135/revista.consinter.00008.10.

The technological improvement of the e-procedure is possible through the use of conceptual models that are already familiar well known in Internet such as hypertext, understood as a dynamic link through a group of text, words, images or sound informations are aggregated. The present essay aims to investigate some of the possibilities related to the use of hyperlinks in the field of Procedural Law, analyzing them under the perspective of the fundamental right to a fair trial. That said, it intends to face the consequences of QR Codes inclusion in procedural acts, referring the reader of such acts to an audiovisual cenarium and, at the same time, concerned with the fundamental right to legal certainty, as well as the implications in the formation of a virtual work community (groupware) over the fundamental right to hearsay.

Keywords : Hypertext; Groupware; E-procedure; Fair trial..
