Investigate the contribution of the realization of custody hearing to the reduction of provisional prisioners in the state of São Paulo. It begins, defining the institute of the custody hearing, its foundation, indicating the characteristics and defining the pourpose of the apresentation of the prisioner immediately to the jugde. Subsequently, the problems faced by the Brazilian prision system are analyzed, especially about the superpopulation with provisional prisoners or awaiting final judgment. In the end, inquires about the effectiveness of the realization of custody hearing for decerceration through anylisis of statistics of the penitentiary system of São Paulo, showing the firts reflections with the realization of the right of presentation.
