The Brazilian Constitution of 1988 established, as a precondition for the admissibility of elective competition, the previous party affiliation. It advocates that international treaties and conventions on human rights amount to constitutional amendments. Faced with the unenforceability of membership in the Pact of San José de Costa Rica, an international treaty does not appear to be a requirement for elective positions. Such a demand serves the conservative and inadmissible conduct of political parties to maintain and condition their members to partisan ties. The present article discusses the possibility and the reasons that justify the so-called single application in Brazil. The methodology will use the deductive-argumentative method of investigation, using bibliographical and documentary techniques to support the conclusions presented.
