Abstract

This work has as object the Federal Penitentiary System in the Brazilian State, considering the prolonged solitary confinement and their consequences for the prisoner. The justification of the thematic relevance refers to the non-observance of constitutional guarantees and the Charter of human rights. The inclusion and maintenance of prisoners in federal maximum security penal establishment should be exceptional measure and for a fixed period. Numerous are the cases of suicides and death in the Federal prison system. The research methodology used is bibliographical and field. One of the objectives of this work: to expand the debate on the subject in order to collaborate with the expansion of managerial/administrative measures to ensure the implementation of the rights in comment; discuss ideas and understand the historical evolution of human rights achievements in this area. One of the conclusions of this study, highlighted that the custody in the Federal prison system is to generate psychic and emotional damage, subjecting the condemned the evils that are not limited to deprivation of liberty. Being a fundamental right, the right to health, a second-generation law, concluded that the disrespect your macula a historic achievement, guaranteed constitutionally.
