Abstract

The text aims to reflect on the changes in the environment of rights protection in Brazil, occurred in recent years, based on the incorporation and strengthening of consensual methods of conflicts resolution, especially after Federal Laws 13.105/2015 e 13.140/2015. Discussions will be focused on conflicts mediation, because of the expectation that it will be able to provide effective resolution to disputes, given the possibility of reestablishing dialogue between the parties involved. The research combines bibliographic review and empirical perceptions. It proposes reflections about some difficulties that were observed in some Brazilian procedural practices.
