This research aims to carry out a reflexive analysis of different types of death with intervention, with emphasis on the practice of dysthanasia, which, as a true therapeutic obstinacy, has been mistakenly used by some health professionals, even when they faced out with terminal patients suffering from an incurable and hopelessly proven disease. The objective is to demonstrate that those unnecessary conduct prolongs terminal patient’s life and makes difficult his natural process of death, causing disproportionate suffering, which is not in line with dignity of the human person moral principle, a fundamental value of the legal system current Brazilian legislation. Finally, this article seeks to demonstrate the relevance of patient’s autonomy of will as a legal valid plea to support valid refusals and for doing anticipated directives of will.
