Abstract

MARTIN, José María Lombardero. THE SPANISH JURY, THE ANGLOSAJON JURY AND THE SCABINAT. INSTRUCTIONS AND VERDICT. BRIEF COMPARATIVE ANALYSIS. Revista Internacional CONSINTER de Direito [online]. 2019, n.9, pp.423-448.  Epub Dec 18, 2019. ISSN 2183-6396.  https://doi.org/10.19135/revista.consinter.00009.23.

In this article we will make use of the comparison to advance in the understanding of the internal logic of the Spanish model of Jury Court, illuminating our institution in the light of the contrast with the Anglo-Saxon Pure Jury and the Court of Escabinos.

The current LOTJ of 1995 did not suppose a rupture with the model of its historical precedents and follows nominally the Anglo-Saxon model of Pure Jury. For this reason, it is pertinent to confront it with the British and American juries that the audiovisual media maintain very present in the collective imagination of Spanish citizens, who can be called to exercise the jurisdictional authority but under the conditions established by the LOTJ.

Keywords : Comparative Law; Jury Court; Pure Anglo-Saxon Jury; Tribunal of Escabinos; Instructions of the Magistrate; Motivation of the verdict.
