The regime of challenging decisions envisaged in the Law of Corporations has been the subject of a profound modification by the Law 31/2014, which has been a restriction of the right to challenge. This reform has resulted in the abolition of the distinction between null and void corporate agreements. The category of challenging decisions has been created, which has affected the catalogue of cases of challenge, and a number of infringements have been collected, to which it will not be possible to challenge a corporate agreement. The reform has also affected the deadline and computation of the expiration of action, and various aspects of active legal capacity, as, in addition, these rules have been unified for all challenging decisions with the exception of corporate decisions contrary to public order.
