The scrutiny of the activity of the public authorities contributes decisively to the “good administration” and to the proper management of the public funds, mainly by virtue of “accountability” mechanisms. The requirement of transparency is felt more acutely in the public procurement sector, since fraud and corruption are often associated with this administrative activity because of the large sums involved in public procurement.

The various aspects of the “Court of Auditors” regulation on public procurement and the scope of this external control will also be addressed in this study.

Finally, we will make our critical remarks about the ethics and transparency, defending its consecration as a general principle of administrative activity in the Code of Administrative Procedure.
