The juridical protection to the cultural heritage is very important for to the protection of the identity and the historical memory of the people. Several international instruments and the different systems of law protect the significant values that integrated it. The juridical protection to the cultural heritage in Cuba demands to be improved since the new Constitution of the Republic, the modern conceptions about the protection of de cultural heritage and for to guarantee fundamental rights, such as: the right to the healthy environment, the right to the culture and the right to enjoy to the common patrimony of the humanity.
