Abstract

CERQUEIRA, Paloma Gurgel de Oliveira. THE HUMAN RIGHT TO HEALTH IN PRISON: UNCONSTITUTIONALITIES OF THE ANTICRIME PACKAGE AND THE RIGHT TO VISIT. Revista Internacional CONSINTER de Direito [online]. 2020, n.11, pp.273-284.  Epub Dec 18, 2020. ISSN 2183-6396.  https://doi.org/10.19135/revista.consinter.00011.12.

The purpose of this study is to analyze Law 13.964 /2019 and the consequences of the prohibition and / or restrictions on visits to prisoners and the evident need for judicial protection under the Human Rights treaties. The thematic relevance is justified given the failure to comply with constitutional guarantees and the human rights charter. Family, affective and social ties are considered solid bases to keep convicts from delinquency. The research methodology consists of extensive research on the literature and specialized bibliography on the subject. The purpose of this paper is to expose the violations of constitutional guarantees and human rights present in the so-called anti-crime package, as well as to highlight the serious psychological and physical consequences suffered by the inmates as a result of some restrictions.

Keywords : Anticrime Pack; Right to health; Right of visit..
