Abstract

GRANADO, Daniel Willian  and  FILHO, Fernando Rey Cota. THE DEVELOPMENT OF THE MASSIFICATION OF PROCESSES IN THE BRAZILIAN CIVIL PROCEDURALSYSTEM AND THE CONTAINING INSTRUMENTS OF THE CIVIL PROCEDURAL SYSTEM. Revista Internacional CONSINTER de Direito [online]. 2020, n.11, pp.557-576.  Epub Dec 18, 2020. ISSN 2183-6396.  https://doi.org/10.19135/revista.consinter.00011.27.

The purpose of this article is to investigate the development of the massification of processes in the Brazilian civil procedural system, approaching, in a nutshell, how legislative production accompanied this new legal-social reality, considering, as an initial landmark, the promulgation of the 1988 Federal Constitution. In addition, we will seek to demonstrate how the civil procedural system, inserted by Law n. 13,105/2015, innovated to contain repetitive litigation, based on the analysis of the various procedural instruments inserted, mainly in view of the precedent system adopted, in favor of the unity of law, legal security, effectiveness and speed, as well as to relieve the Brazilian Judiciary.
