In times of uncertainty and constant changes, the matter of the punitive damages for injury to the personality rights and environment, caused by great corporations, leads to a necessity of representing the institutes, integrating the national legal system in a international context. The presente research insert in the ivertigation the matters inherent to the personality rights and human rights, as well as, the institutes of the civil responsability and the autonomy of the civil penalty before the institute of the moral damage and it's unfoldings, in face of the XXI century society. In this context, sought to comprehend the Law and it's possible new roles, in special in the national legal system, pointing necessary alterations to it's evolution with the finalty of restraining the recurrence of harmful conduct by the great corporations.
