From the debate on people who are in a state of misery or sick, unable to guarantee their own subsistence and that of their family, this article aims to discuss the contexto of the construction of social securitu and social assistance in Brazil, as an instrument for the effectiveness of human rights. It should be noted that the lack of academic production on the subject justifies the importance of this article. Thus, based on bibliographic and documentar research, the article seeks to problematize and identify what is available in the international and Brazilian normative order that provide questions for the debate, in Brazil, about the need to build social assistance rights for people in need. This leads to the discussion about how this normative construction could contribute to the effectiveness of this instrument of human rights, despite the data collected in the Brazilian Transparency Portal, whose results especially indicate the need to implemente new instruments of assistance in situations of vulnerability, in the direction of progress towards the Sustainable Development Goals.
