The objective of this paper is to analyze the institute of public civil action in light of two of its main characteristics, namely, extraordinary legitimacy and the territorial limitation of the effects of res judicata. Therefore, the concepts of ordinary and extraordinary legitimacy will be studied in depth, as well as the novelty brought by the current Code of Civil Procedure regarding the possibility of negotiated extraordinary legitimacy. Furthermore, the legitimacy of the public civil action itself will be analyzed, as well as the legislative attempt to territorially limit the effects of its sentence only to the place of jurisdiction of the court that rendered it, ending with the examination of the recent jurisprudential thesis that aimed to circumvent such territorial limitation.
