The objective of the essay is to convey the possibility of written testimony in civil proceedings. The methodology dialogues with epistemology, dogmatics and the legislative text, presenting an evidence context that results in the limitation of the use of written testimony, but states for the epistemic possible to reinforcement this evidence in court.
