In this article, a study is made of the configuration of the right to a healthy environment in the Cuban legal system and its judicial protection based on the theory of fundamental rights. Through a legal and exegetical theoretical analysis and, based on comparative law, the main problems that affect the jurisdictional guarantees of the aforementioned law in Cuba are determined, based on its recognition as fundamental in the 2019 Constitution.
