Abstract

LOBAO, Simone Lavôr do Rêgo  and  REIS, Daniel Gustavo Falcão Pimentel dos. PARTY AUTONOMY IN CONTEMPORARY DEMOCRACIES: SARTORI, PANEBIANCO AND NASSMACHER. Revista Internacional CONSINTER de Direito [online]. 2023, n.17, pp.383-398.  Epub Feb 28, 2024. ISSN 2183-6396.  https://doi.org/10.19135/revista.consinter.00017.17.

Autonomy is guaranteed to political parties in contemporary democracies so that acronyms can perform the functions assigned to them in each legal system and manage the resources available to them in accordance with the values enshrined in the statutes and programs. parties and in accordance with the electoral strategies adopted to achieve their political goals. In this perspective, party autonomy is aimed at promoting political pluralism in the political context outlined in the 21st century. The theme of party autonomy, although it is a very relevant matter, receives little attention from Brazilian legal doctrine, which generates a deficit in the bibliographic collection specialized in the subject and, when analyzed, party autonomy is defined in the light of the Brazilian legislation and jurisprudence. Faced with this, the question is how party autonomy is conceptualized by foreign experts? To answer the question, this article presents the concepts stipulated by Giovanni Sartori, Ângelo Panebianco and Karl-Heinz Nassmacher on party autonomy. Furthermore, it defines what political parties are in contemporary democracies with a view to delineating the political context in which party autonomy is inserted. Finally, the party functions are exposed with the purpose of illustrating the range of choices that autonomy makes possible to the associations. The methodology used is bibliographic and dialectical. As a result, there is the introduction of new doctrinal concepts about party autonomy in the Brazilian legal system.
