Simultaneamente, a magistratura judicial tem vindo a ser qualificada como uma profissão com intensidade de trabalho elevada, nomeadamente devido às exigências cognitivas e emocionais a que estão sujeitos, em especial em áreas como o crime e a família e menores. Recorrendo às contribuições da sociologia das emoções e direito (law and emotion), este artigo parte dos dados recolhidos num inquérito online para refletir sobre as perceções dos juízes de primeira instância portugueses quanto às exigências cognitivas e emocionais do seu trabalho. Toma-se como objetivos: identificar as diferenças entre as perceções dos juízes a exercer funções nos juízos especializados e nos juízos de competência genérica; refletir sobre as potenciais consequências das perceções negativas dos juízes quanto às exigências emocionais e cognitivas na elaboração das decisões judiciais; e apresentar questões e hipóteses para projetos futuros. Os dados apresentados neste artigo evidenciam diferenças significativas entre os juízos e áreas de atuação, com impacto desproporcional nos juízes que trabalham em matérias como família e menores e crime, onde as exigências emocionais são particularmente elevadas. Apesar do guião cultural que descreve o juiz como alguém que não se deixa afetar pelas emoções, os dados apresentados e as contribuições da law and emotion demonstram que o trabalho judicial envolve inevitavelmente circunstâncias em que as emoções são sentidas e necessitam de ser geridas. Deste modo, o reconhecimento das emoções como parte legítima e positiva do trabalho judicial revela-se essencial para mitigar as perceções de intensidade cognitiva e emocional associadas à profissão, contribuindo, por um lado, para a melhoria das condições de trabalho e bem-estar dos juízes e, por outro, para reforçar a confiança do público nos tribunais e na imparcialidade do poder judicial. Tendo em conta o seu caráter maioritariamente exploratório, este artigo pretende ser um apelo e ponto de partida para a realização de mais estudos sobre esta temática no contexto português.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract The legal culture is characterized by the denial of emotion and the emphasis on objectivity, neutrality, and impartiality. At the same time, the judiciary has been recognized as a profession with high-intensity work, particularly due to the cognitive and emotional demands placed on judges, especially in areas like criminal and family law. Drawing on contributions from law and emotion, this article uses data gathered from an online survey to explore the perceptions of Portuguese first-instance judges regarding the cognitive and emotional demands of their work. The objectives are to: identify differences between the perceptions of judges working in specialized courts and those in general jurisdiction courts; consider the potential consequences of judges&#8217; negative perceptions regarding emotional and cognitive demands on the judicial decision-making process; and present questions and hypotheses for future research projects. The data presented in this article highlights significant differences between judicial roles and areas of practice, with a disproportionate impact on judges working in fields such as family and juvenile law and criminal law, where emotional demands are particularly high. Despite the persistent cultural script of judicial dispassion, the data presented and insights from the field of law and emotion demonstrate that judicial work inevitably involves circumstances in which emotions are experienced and must be managed. Thus, recognising emotions as a legitimate and positive aspect of judicial work proves essential for mitigating perceptions of cognitive and emotional intensity associated with the profession. This, in turn, contributes both to improving judges&#8217; working conditions and well-being and to strengthening public trust in the courts and the impartiality of the judiciary. Given its predominantly exploratory nature, this article aims to serve as a call to action and a starting point for further studies on this subject within the Portuguese context.]]></p></abstract>
