<self-uri xlink:href="http://scielo.pt/scielo.php?script=sci_arttext&amp;pid=S2183-95222020000100181&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://scielo.pt/scielo.php?script=sci_abstract&amp;pid=S2183-95222020000100181&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://scielo.pt/scielo.php?script=sci_pdf&amp;pid=S2183-95222020000100181&amp;lng=en&amp;nrm=iso"></self-uri><abstract abstract-type="short" xml:lang="pt"><p><![CDATA[Resumo O presente artigo objetivou analisar, na ordem jurídica brasileira, questões atinentes à judicialização da saúde, em especial sobre a atuação da 8ª Câmara Cível do Tribunal de Minas Gerais. Foi realizada pesquisa precipuamente qualitativa, do tipo exploratória, fazendo uso de instrumentos de coleta de dados de pesquisa bibliográfica e documental. A saúde consta como um dos direitos sociais previstos no art. 6º, que abre o Capítulo II (&#8216;Dos Direitos Sociais&#8217;) do Título II (&#8216;Dos Direitos Fundamentais&#8217;) da Constituição Federal de 1988. Além disso, o caput do art. 196, Constituição Federal de 1988, define a saúde como direito de todos e dever do Estado. O art. 2º da Lei 8.080 de 1990 dispõe, por sua vez, que a saúde é um direito fundamental do ser humano, devendo o Estado prover as condições indispensáveis ao seu pleno exercício, o que foi destacado no referencial teórico pesquisado - principalmente SOUSA, 2015 e ANDRADE, 2015. Logo, evidencia-se que a saúde é um direito fundamental social, que, para ser otimizado, precisa da atuação positiva do Estado, no intuito de assegurar vida digna aos cidadãos. Diante da precariedade do sistema brasileiro público de saúde, aliada ao número insuficiente de fornecimento de medicamentos e/ou tratamentos médicos e procedimentos cirúrgicos, bem como ausência de recursos ou descumprimento de políticas públicas, surge a denominada &#8220;judicialização da saúde&#8221;, tendo em vista que o cidadão sem condições financeiras procura socorrer-se ao Judiciário em busca dos seus direitos. Urge destacar, que a invocação do princípio da reserva do possível, como limitação financeira e suposto prejuízo do ente público, por si só, não justifica a falta de atendimento em relação ao acesso aos serviços de saúde. Há, pois, um longo caminho a percorrer visando um intenso e constante processo de melhoria de qualidade da saúde. Contudo, no que tange ao Direito à Saúde no Brasil, é preciso estabelecer um ponto de equilíbrio entre os direitos sociais fundamentais dispostos na Constituição Federal e as limitações orçamentárias alegadas pelo ente estatal, sendo razoável estabelecer critérios e parâmetros para sua concessão.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract This article has objectified to analyse questions related to the judicialization of health care in Brazil, especially related to the performance of the 8th civil court of the Court of Justice of the State of Minas Gerais. A qualitative, exploratory research was carried out, using bibliographic and documental research to collect data. Health care belongs to one of the social rights guaranteed under the Article 6 from the Chapter II (&#8216;Social Rights&#8217;) included in the Title II (&#8216;Fundamental Rights&#8217;) found in the Federal Constitution of 1988. Thus, according to the chapter II, article 196 from the Federal Constitution of 1988, health care represents a right of any citizen and an obligation of the state. The Article 2 from the Law Number 8.080 of 1990 stresses, in turn, that health care is a fundamental right of every human and that the state must provide all the necessary conditions for enabling this right to everyone, which was highlighted in the researched theoretical framework - mainly SOUSA, 2015 e ANDRADE, 2015. Therefore, it is evident that health care is a fundamental social right that requires positive action from the state in order to secure a dignified life for all citizens. It is with Brazil&#8217;s precarious public health system, combined with the insufficient number of medications and/or medical treatment and surgical procedures, as well as the lack of resources or noncompliance with public policies, that the so-called judicialization of health care has emerged, as citizens with no financial resources must rely on the judiciary in order to secure their rights. It is valuable to point out that falling back on the principle of the reserve of the possibilities clause to explain the financial limitation and supposed loss of the state does not justify not providing access to health services. Indeed, there is a long way to go in the process of improving the quality of health care in Brazil. Nevertheless, as long as the right to health in Brazil is concerned, it is necessary to find the balance between the most basic social rights found in the Federal Constitution and the alleged constitutional budget limitations. Therefore, it is certainly reasonable for us to set out criteria and parameters for its concession.]]></p></abstract>
