<self-uri xlink:href="http://scielo.pt/scielo.php?script=sci_arttext&amp;pid=S2183-95222024000100477&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://scielo.pt/scielo.php?script=sci_abstract&amp;pid=S2183-95222024000100477&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://scielo.pt/scielo.php?script=sci_pdf&amp;pid=S2183-95222024000100477&amp;lng=en&amp;nrm=iso"></self-uri><abstract abstract-type="short" xml:lang="pt"><p><![CDATA[Resumo O artigo objetiva analisar a aplicação da consensualidade no âmbito da execução penal, notadamente a introdução do termo de ajustamento de conduta (TAC), por meio da Portaria do antigo Departamento Penitenciário Nacional nº 275/2016, e tem como hipótese que tal procedimento poderia representar um avanço em termos de celeridade dos processos internos dos estabelecimentos penitenciários, além de se traduzir em importante ferramenta para dissuasão e prevenção de novos ilícitos disciplinares. Fundamenta-se em uma perspectiva pragmática do Direito Administrativo Sancionador, o qual tem a missão de tutelar o interesse público projetado no ordenamento jurídico em contextos marcados pela complexidade e dinamicidade das relações sociais. A metodologia utilizada foi a promoção de um debate dialético entre textos fundamentais sobre essa área do Direito e a consensualidade, as legislações vigentes e os métodos de utilização da consensualidade no contexto da execução penal, em especial o Termo de Ajustamento de Conduta. Como ponto de partida, defende-se que as sanções disciplinares devem ser compreendidas como instrumentos para a consecução das finalidades públicas que reclamam uma atuação estatal que supere a lógica binária lícito/ilícito, buscando soluções que produzam os melhores resultados para a sociedade. Argumenta-se que o sistema de punições e incentivos que perpassa a execução da pena privativa de liberdade deve levar em conta a potencial dupla função das sanções disciplinares: garantir ordem e disciplina sem deixar de promover a integração social do sentenciado. O texto conclui que a introdução da consensualidade, por meio da citada portaria, pode ser um instrumento efetivo à disposição da administração penitenciária, mas impõe cautelas em sua aplicação, a fim de não gerar espaço para arbitrariedades. Ademais, conclui que a Portaria nº 275/2016 demanda melhor densificação e detalhamento, para que se justifique o TAC como um exercício de potestades sancionadoras disciplinares apto a promover o interesse público na conformidade de condutas.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract The article aims to analyze the application of consensuality in the context of criminal execution, particularly the introduction of the term and adjustment of conduct, through the Ordinance of the former National Penitentiary Department nº 275/2016 and has the hypothesis that such a procedure could bring improvements to, at least, the speed of the internal processes of penitentiary establishments. It is based on a pragmatic perspective of Sanctioning Administrative Law, which has the mission of protecting the public interest projected in the legal system in contexts marked by the complexity and dynamism of social relations. The methodology used was the promotion of a dialectical debate between fundamental texts on this area of law and consensus, current legislation and methods of using consensus in the context of criminal execution, in particular the Term of Adjustment of Conduct. As a starting point, it is argued that disciplinary sanctions should be understood as instruments for achieving public purposes that require state action that goes beyond the licit/illicit binary logic, seeking solutions that produce the best results for society. It is argued that the system of punishments and incentives that permeates the execution of the custodial sentence must take into account the potential double function of disciplinary sanctions: guaranteeing order and discipline while promoting the social integration of the convict. The text concludes that the introduction of consensuality by means of the aforementioned ordinance can be an effective instrument available to the penitentiary administration, but it imposes caution in its application, in order not to generate arbitrariness. Furthermore, it concludes that Ordinance nº 275/2016 demands improvement in terms of densification and detailing, so that the TAC can be justified as an exercise of disciplinary sanctioning powers capalbe of promoting the public interest in the conformity of conduct.]]></p></abstract>
