The article 35º of the Portuguese Constitution states the right of "computer science use" among the fundamental rights, liberties and warranties. This constitutional asset has suffered a constant evolution in recent constitutional history, and was the object of an unconstitutionality decision by lack of law by the Portuguese Constitutional Court. The law of protection of personal data is based on the principles established by this article.
