Abstract
NALIN, Paulo and PIMENTEL, Mariana Barsaglia. THE CONTRACT AS TOOL OF ACCOMPLISHMENT OF HUMAN RIGHTS IN THE MARKET: THE ETHICAL STANDARDS. Revista Internacional CONSINTER de Direito [online]. 2019, n.8, pp.459-478. Epub June 28, 2019. ISSN 2183-6396. https://doi.org/10.19135/revista.consinter.00008.26.
This article aims to analyze the approximation between the ethical issues and the business relations and, especially, how it reflected in the contracts. It is not new that the business societies in general, especially transnational corporations, began to worry about protecting and promoting human rights in their relationships, and in their internal and external operations, adopting and requiring ethically acceptable behavior, of its employees, as well as of its contractual partners. Such a conjecture has led to the incorporation of ethical standards into the contracts themselves, through the insertion of so-called ethical standards. The proposal, therefore, is to study these contractual clauses in the context of the ‘new’ Contract Law, regarding, in the end, the legal regulation of ethical standards in the United Nations Convention on Contracts for the International Sale of Goods (CISG).
