^lpt^aA elaboração de uma Constituição assume-se como um elemento estruturante para o desenvolvimento de um Estado numa situação de pós-conflito, para a coexistência pacífica dos seus cidadãos e, em última análise, para garantir a coesão e reconciliação social, bem como uma paz duradoura. O presente artigo aborda a importância da dimensão político-constitucional como elemento do statebuilding, analisando os dilemas e perversidades inerentes, designadamente os que resultam da intervenção dos actores externos. As lições que se podem retirar do caso extremo do Iraque são relevantes para identificar os limites do auxílio externo na elaboração de uma Constituição num processo de transição política pós-conflito, bem como as áreas em que pode ser optimizado. O artigo argumenta que a intervenção dos actores internacionais é benéfica se for marginal ou mesmo parcial num nível de baixa intensidade.^len^aThe making of a Constitution is a fundamental process towards the development of a post-conflict State, the peaceful coexistence of its citizens and, in the end, to guaranty the social cohesion and reconciliation, as well as a lasting and sustainable peace. The present article focuses on the relevance of the politico-constitutional dimension as a statebuilding element, analyzing the inherent dilemmas and perversities that may result from the intervention of external actors. The lessons that may be learned from the case of Iraq are relevant in order to identify the limits from external assistance on the making of a Constitution within a post-conflict political transition process, as well as the areas in which it can be optimized. This article argues that the intervention by external actors can be constructive if marginal or even partial at a low intensity level.
