The present analysis addresses the inefficiency and inefficacy of African national and regional jurisdictions in the promotion and protection of human rights, both in national constitutions and in regional documents and jurisdictions, such as the African Charter on Human and Peoples' Rights and the African Court on Human and Peoples' Rights. The result of the above-mentioned inefficiency is the overall disrespect for human rights in Africa and the growth of a culture of impunity and silence. The ensuing action of the International Criminal Court (ICC) in the continent has led to a confrontation with some African governments which, within the framework of the African Union, challenge the autonomy and universality of the ICC.
